SkyBall™ Pre-Order Giveaway Terms & Conditions
Official Rules
1. Eligibility
The SkyBall™ Pre-Order Giveaway (the "Giveaway") is open to legal residents of the United States who are at least eighteen (18) years old at the time of entry and who place a pre-order for any SkyBall™ product between the Giveaway start and end dates. Employees of SkyBall™, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and their immediate family members are not eligible to participate in the Giveaway.
2. Giveaway Period
The Giveaway begins when pre-orders open and ends on May 31, 2024, at 11:59 PM Eastern Time. All pre-orders must be placed by this time to be eligible.
3. How to Enter
To enter the Giveaway, place a pre-order for any SkyBall™ product through our official website or authorized retailers. Each pre-order counts as one entry, regardless of the number of items or total purchase amount. Limit one entry per person/household.
4. Prizes
Three (3) winners will be selected to receive free SkyBall™ gear. Prizes may include SkyBall™ rackets, balls, nets, or other merchandise. Prizes are non-transferable, and no substitution will be made except as provided at SkyBall™'s sole discretion.
5. Winner Selection and Notification
Winners will be selected in a random drawing from among all eligible entries on June 3, 2024. Winners will be notified by email within five (5) days following the winner selection. SkyBall™ shall have no liability for a winner's failure to receive notices due to spam, junk e-mail, or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information.
6. Rights Granted by You
By entering this Giveaway, you understand and agree that SkyBall™, anyone acting on behalf of SkyBall™, and SkyBall™'s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
7. Terms & Conditions
SkyBall™ reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond SkyBall™'s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway.
8. Limitation of Liability
By entering, You agree to release and hold harmless SkyBall™ and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error in the administration of the Giveaway or the processing of entries.
9. Disputes
This Giveaway is governed by the laws of the United States and the state of New York, without respect to conflict of law doctrines. As a condition of participating in this Giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction.
10. Privacy Policy
Information submitted with an entry is subject to the Privacy Policy stated on the SkyBall™ website.
11. Winners List
To obtain a copy of the winner's name or a copy of these Official Rules, email your request to: info@skyball.us with Subject Line 'Early Bird Giveaway'. Requests must be received no later than July 3, 2024.
12. Sponsor
The Giveaway is sponsored by SkyBall™.
13. Social Media Platforms
The Giveaway is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or any other social media platform.
